Certification
Effective Oct. 4, 2004, the Missouri Department of Transportation entered into a Memorandum of Understanding with partnering DBE certifying agencies in the State of Missouri, including the City of St. Louis-St. Louis Lambert International Airport, Bi-State Development/METRO, Kansas City Area Transportation Authority, City of Kansas City and Mid-America Regional Council. The partnering agencies form the Missouri Regional Certification Committee (MRCC).
Under the Memorandum of Understanding, the MRCC members agree that any and all firms certified as a DBE and/or ACDBE by any MRCC member shall be recognized as being certified in accordance with 49 CFR Part 26 and Part 23 such certification will be accepted by all MRCC members.

Do I Qualify for Disadvantaged Business Enterprise (DBE) and/or Airport Concessions Disadvantaged Business Enterprise (ACDBE) Certification?
Disadvantaged Business Enterprise or DBE is a for-profit small business concern engaged in business activities at least 51 percent owned by one or more individuals who are both socially and economically disadvantaged; and whose management and daily business operations are controlled by one or more of the socially and economically disadvantaged individuals who own it. Additionally, firms must meet the following:
Business Size Determination – A firm (including its affiliates) must be a small business as defined by SBA standards. It must not have annual gross receipts in excess of the DBE/ACDBE size limits. DBE/ACDBE Size Standards | US Department of Transportation
Ownership – Your business must be 51% owned by a socially and economically disadvantaged individual(s).
“Disadvantaged” – Pursuant to the Infrastructure, Investment, and Jobs Act the Department presumes certain groups are disadvantaged, including women, Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans, Subcontinent Asian-Pacific Americans, or other minorities found to be disadvantaged by the U.S. Small Business Administration (SBA).
Persons who are not members of one of the above groups and own and control their business may also be eligible if they establish their “social” and “economic” disadvantage.
Personal Net Worth – The owner(s) of the business must have a personal net worth that is below the applicable limit, which is adjusted every 3 years.
Control – One or more disadvantaged owner(s) seeking certification must control the firm.

Apply for or Maintain Certification
Certification for purposes of the DBE and ACDBE programs should be limited to eligible DBEs and ACDBEs that intend to bid on work as prime or subcontractors on DOT-assisted contracts or airport concessions contracts, respectively.1 This includes both construction and non-construction work in the transportation industry at large. DOT funding recipients may emphasize this information to applicant firms and State and local agencies, and may make inquiries into the nature of the firm’s work and what the firm seeks to achieve with certification. Recipients may recommend that a firm not pursue certification if the firm expresses that it has no intention of participating in or bidding on DOT-assisted contracts or airport concessions contracts. If a firm withdraws its application before you have issued a decision, the firm may resubmit an application at any time.2
1 49 CFR § 23.37(b) of the ACDBE Program Regulation states that recipients “are not required to certify a part 26 DBE as a part 23 ACDBE if the firm does not do work relevant to the airport’s concessions program.” 49 CFR § 23.55(k) prohibits counting “costs incurred in connection with the renovation, repair, or construction of a concession facility (sometimes referred to as the “build-out”).” Thus, you are not required to certify firms that are participating in the build-out of a concession and not countable since they are not performing work relevant to the concession program.

Interstate Certification
Firms currently certified in a jurisdiction outside of Missouri are required to submit an online application, Declaration of Eligibility (DOE), statement listing all jurisdictions they are currently certified in including their jurisdiction of original certification (JOC) and a copy of their JOC DBE directory listing showing their current certification.
